RRE International has decided to apply for a series of environmental permits so that they can begin construction and operation of the smelter in the City of Riverside. Because this is the first time RRE International established a presence in the United States, it seeks your law firm’s guidance in determining what permits might be needed and what issues it may face in obtaining authority to construct its facility and undertake operations. The Company believes it will need permits for the various parts of its operation as it intends to build and operate the smelter, to construct outfalls that will discharge into the Long Trout River, and store and transport hazardous waste to a TSDF. Additionally, the Company is concerned about opposition from residents in the surrounding community who may oppose the building of the facility, and also the reaction of state and local officials to locating the facility in their area.
RRE International requests that your law firm research and prepare a 6–8 page report that will assist in obtaining the necessary environmental approvals to build and operate the smelter and how to deal with any potential opposition, including determining what if any rights citizens and officials in the surrounding community will have to the facility. Finally, provide a conclusion that includes recommendations as to how the Company should proceed in obtaining the necessary permits and approvals to undertake construction and begin operations.
Your Final Research Project will require you to prepare a memorandum of law to your supervising attorney outlining the issues and law associated with RRE International’s requests. Be sure to address how to deal with any potential opposition, including determining what if any rights citizens and officials in the surrounding community will have to the facility.
Additionally, provide a conclusion that includes recommendations as to how the Company should proceed in obtaining the necessary permits and approvals to undertake construction and begin operations.
Ensure that the Memorandum is:
- 6–8 pages in length;
- Double-spaced and in a 12-point font;
- Well-written and grammatically correct;
- Organized in a logical fashion that makes it easy to follow and understand; and
- Cited properly.
