MN506-1: Apply theoretical frameworks and concepts to ethical dilemmas in the advanced practice role.

PC 2.3: Demonstrate integrity through the application of relevant codes of conduct and social responsibility within one’s profession.

Instructions:

Create an ethical legal decision-making dilemma involving an advanced practice nurse in the field of education, informatics, administration, or a nurse practitioner. Apply relevant codes of conduct that apply to the practice of nursing and your chosen field.

Include one ethical principle and one law that could be violated and whether the violation would constitute a civil or criminal act based on facts.

Construct a decision that demonstrates integrity and that would prevent violation of the ethical principle and prevent the law from being violated.

Describe the legal principles and laws that apply to the ethical dilemma.

Support the legal issues with prior legal cases or state or federal statutes.

Analyze the differences between ethical and legal reasoning and apply an ethical-legal reasoning model in the case study to create a basis for a solution to the ethical-legal dilemma.

List three recommendations that will resolve advanced practice nurses’ moral distress in the dilemma you have presented.

Based on the issue you presented and the rules of the law, apply the laws to your case and come up with a conclusion.

Note:

This is a fact-based Assignment that will not include your opinion.
This will require research and support for what is written.
The Assignment should be in your words after reading the scholarly and fact-based publications and have proper citations. There should be no quotations. The professor wants to hear your voice as a masters trained nurse.

Description

In the Unit 2 topic 1 Discussion, you will choose an ethical-legal dilemma that would cause the advanced practice nurse moral distress.

The paper should have a minimum of seven citations and some of these should be case law or applicable statutes.

There are myriad ethical-legal dilemmas that nurses relive and find them almost unable to make sound decisions about the case at hand. After a thorough research, I have focused on the following major dilemma; advanced practice nurses who are in the field of nurse practitioner and mainly dealing with pediatric patients find themselves most often than not in such career situations.

The pediatric department deals with kids of all ages. It is general knowledge that infancy is one of the most delicate stages of the growth, development and metamorphosis of humans. If infants are not given keen medical attention at an early age, the ending result could be life changing (Eliopoulos, 2010). Now, I take one practical case where a nurse with an advanced practice license was involved in an ethical-legal decision-making dilemma involving a critically ill infant. To make matters worse, the infant was a newborn.

This infant was suffering from a very complicated malady known as erythroblastosis fetalis. The above is a condition where maternal blood is incompatible with fetal blood, where the mother’s blood is rhesus negative, and the baby’s blood is rhesus positive. Since antibodies will always fight antigens, the mother’s immune system will treat the Rh factor in fetal blood as a foreign and harmful material. It hence responds by triggering a reaction that the baby’s erythrocytes and this may be fatal. To make matters worse, this condition was been detected too late, and the baby was a second born (Tabloski, 2010).

The infant was admitted to the intensive care unit in critical condition and was placed on life support. However, it is clear that the probability of survival of the newborn was very slim and without life support, the baby would die. The dilemma here is whether to withdraw the life-sustaining equipment for the infant patient or not (Daly, 2005).

What further complicates the decision-making process is the fact that we as nurses are guided by the code of conduct regarding our profession. These codes include: listening and responding to the preferences and concerns of patients, acting in the best concern of the society at all times, communicate clearly, working co-operatively and most significant of all, being responsible and fully accountable for your decisions to delegates, patrons, medical consumers and administrators (Eliopoulos, 2010). Given the above, such a situation may cause physical, emotional and mental trauma to the nurse. This is because the best decision here is to forego the life support equipment instead of allowing the patient to accumulate hospital bills under the facility and yet, in the long run, the patient won’t survive. However, doing that would raise more ethical-legal concerns and problems- all weighing down on the same nurse. So, what is the unsurpassed progress of action?
